Dark Gloomy Art respects your privacy. This Privacy Policy explains how Dark Gloomy Art Ltd (“Dark Gloomy Art”, “we”, “us” or “our”) collects, uses and protects personal information when you visit or use the marketplace at marketplace.darkgloomyart.com.
It applies to marketplace visitors, account holders, buyers and sellers. It does not replace the privacy notices of independent sellers, Stripe, Sharetribe or other services that act as separate controllers of your information.
1. Who Is Responsible for Your Information?
Dark Gloomy Art Ltd is the controller of personal information processed for operating and administering the marketplace.

2. Information We Collect
Depending on how you use the marketplace, we may collect:
- Account and identity information: name, email address, profile details, account identifiers and authentication information;
- Seller and verification information: business status, country, payout status and information required to support seller onboarding and compliance;
- Listing information: artwork descriptions, photographs, prices, location, provenance and other material you submit;
- Transaction information: purchases, sales, delivery details, transaction status, commission, refunds and dispute records;
- Communications: marketplace messages, enquiries, support requests, feedback and reviews;
- Technical information: IP address, browser, device, operating system, pages viewed, referring URLs, timestamps and security logs;
- Preferences: communication, language and cookie choices; and
- Information from third parties: payment and verification status from Stripe, marketplace data from Sharetribe, and information from service providers where permitted by law.
Stripe collects payment-card, bank-account and identity-verification information directly. Dark Gloomy Art generally does not receive complete card or bank-account numbers.
3. How We Use Personal Information
We use personal information to:
- create, authenticate and manage accounts;
- display profiles and listings;
- enable buyers and sellers to communicate and transact;
- process marketplace payments, seller commission, refunds and payouts through Stripe;
- provide customer support and handle complaints or disputes;
- prevent fraud, abuse, prohibited listings and security incidents;
- moderate content and enforce our Terms of Service;
- maintain, analyse and improve the marketplace;
- send service messages and, where permitted, marketing communications;
- meet accounting, tax, regulatory and legal obligations; and
- establish, exercise or defend legal claims.
4. Our Lawful Bases
Under UK data-protection law, we rely on one or more of the following lawful bases:
- Contract: where processing is necessary to provide the marketplace services you request or take steps before entering a contract;
- Legal obligation: where we must keep records, respond to lawful requests or comply with tax, fraud-prevention and regulatory requirements;
- Legitimate interests: to operate, secure and improve the marketplace, support users, prevent misuse and protect our business and community, where those interests are not overridden by your rights;

Where we rely on consent, you may withdraw it at any time without affecting processing already carried out.
5. When Information Is Required
Some information is required to create an account, complete a transaction, receive a payout or meet legal and verification requirements. If you do not provide it, we may be unable to offer the relevant feature.

We share personal information only where reasonably necessary, including with:
- Other users: for example, a buyer and seller receive information needed to communicate, complete delivery and resolve a transaction;
- Sharetribe: which provides marketplace infrastructure and account, listing, messaging and transaction services;
- Stripe: which provides payment processing, seller onboarding, identity verification and payouts;
- Render and technical providers: which support hosting, delivery, security, monitoring and maintenance;
- Professional advisers: including accountants, insurers, auditors and legal advisers;
- Authorities and rights holders: where disclosure is required by law or reasonably necessary to address fraud, safety, intellectual-property infringement or legal claims; and
- A successor organisation: if our business or relevant assets are reorganised, sold or transferred, subject to appropriate safeguards.
We do not sell personal information.
Information you choose to publish in a profile or listing may be visible publicly. Do not publish personal information that you do not want others to see.
7. International Transfers
Some providers may process information outside the United Kingdom. Where UK data-protection law requires safeguards, we rely on an applicable adequacy regulation, approved contractual protections such as the UK International Data Transfer Agreement or UK Addendum, or another lawful transfer mechanism.

8. How Long We Keep Information
We keep information only for as long as reasonably necessary for the purposes described above.
Account and listing information is generally retained while an account is active. After closure, we may retain limited records to complete transactions, handle disputes, prevent fraud and meet legal obligations. Transaction, commission, tax and accounting records may normally be retained for up to six years after the relevant financial year or longer where law or an active claim requires it.
Technical and support records are retained according to their operational, security and legal purpose. Public content may remain in backups for a limited period after deletion.
9. Security
We use reasonable organisational and technical measures intended to protect personal information, including access controls, encrypted connections and trusted payment processing. No online service can guarantee absolute security. You should use a strong, unique password and contact us promptly if you believe your account has been compromised.
10. Cookies and Similar Technologies
The marketplace uses essential cookies and similar technologies to provide login, security, account and transaction functions. We may also use optional analytics or preference technologies where enabled and permitted.
Where consent is required, non-essential cookies should not be placed until you choose to accept them. You can adjust browser settings and any cookie controls made available through the marketplace. Blocking essential cookies may prevent parts of the service from working.
11. Marketing
We may send operational messages needed to administer your account or transactions. Marketing messages are sent only where we have permission or another lawful basis. You can unsubscribe using the link in a marketing email or by contacting us.

The marketplace is intended for adults. Users must be at least 18 years old to use transactional features. We do not knowingly collect information from children through marketplace accounts. Please contact us if you believe a child has provided personal information.

We do not currently make decisions that produce legal or similarly significant effects based solely on automated processing. Our providers may use automated signals to help prevent fraud or secure payments, subject to their own policies and applicable law.

The marketplace contains links to independent websites and services, including sellers’ pages and social platforms. Their privacy practices are governed by their own policies, and we are not responsible for those practices.
