Sellers are asked to provide clear information about their artwork, including the artist or maker, date, century, medium, dimensions, condition, framing and attribution where applicable.

Please review the full description and photographs carefully before purchasing. For original or higher-value works, we recommend requesting further photographs or information from the seller if anything is unclear.

Originals & Reproductions

Every artwork must be identified as either Original or Reproduction.

An original is a work created by the artist or maker. This can include paintings, drawings, sculptures and illustrations, as well as artist-produced prints such as etchings, engravings and lithographs.

A reproduction is a later copy or print made from an existing artwork, including fine art prints, giclée prints and facsimiles. Where a reproduction is based on an older artwork, the stated century and artwork date refer to the original work.

Attribution & Provenance

Historical works are not always accompanied by definitive documentation of authorship. Listings may therefore use recognised art-market terms such as Attributed to, Workshop / Studio of, Circle / Follower of, After the Artist, or Unknown / Anonymous. These descriptions should not be treated as equivalent to confirmed authorship.

Where available, sellers may also provide provenance, including previous ownership, gallery, dealer, exhibition or auction information. Not every artwork will have documented provenance, so buyers should consider all available information carefully.

Condition, Framing & Dimensions

Older artworks will often show signs of age. Sellers are asked to identify the overall condition of a work and disclose notable wear, damage or restoration in the listing.

Please examine the photographs carefully and request additional images where condition is particularly important to your purchase.

Measurements are provided in centimetres and, unless otherwise stated, refer to the artwork itself rather than the external dimensions of the frame.

Dark Gloomy Art brings together independent artists, collectors, galleries and art dealers. Seller profiles may include their location, business or gallery name and information about their background.

We encourage buyers to review both the artwork listing and seller profile before making a purchase. Payments should always be completed through the Dark Gloomy Art marketplace checkout. Never send payment outside the marketplace in response to an unsolicited request.

Shipping, Delivery & Returns

Delivery arrangements can vary depending on the artwork's size, value and location. Please review the shipping information provided before completing your purchase. Original paintings, framed works and sculptures may require specialist packaging or insured delivery.

International purchases may also be subject to customs duties, import taxes or other local charges.

When your artwork arrives, inspect it promptly and retain the original packaging until you are satisfied with its condition. If the parcel or artwork appears damaged, photograph both the packaging and the artwork and contact the seller promptly.

Sellers may be established businesses or individuals selling from a private collection. We ask that every seller provides accurate information about themselves and the works they offer, and conducts all transactions in a professional and transparent manner. Whether you are offering a single artwork or regularly listing pieces, the same standards of accuracy, presentation and communication apply.

What You Can Sell

Dark Gloomy Art is a marketplace for original artworks and fine art reproductions from both the past and present. Suitable works may include paintings, drawings, illustrations, prints, sculptures and other forms of visual art that fit within the marketplace.

Both historic and contemporary works are welcome. Artwork does not need to be exclusively gothic or macabre, but the marketplace is particularly suited to pieces with atmosphere, individuality, unusual subject matter or a distinctive visual character. Reproductions are permitted, provided they are clearly and accurately identified as reproductions and are not presented in a way that could lead a buyer to believe they are original works.

Creating an Accurate Listing

A strong listing should give a buyer enough information to understand exactly what is being offered before making a purchase. Sellers are asked to provide accurate details wherever applicable, including the artist or maker, artwork date, century, medium, dimensions, condition, framing, attribution and provenance.

Descriptions should be clear and factual. If information is uncertain, this should be stated rather than presented as established fact. Approximate dates, uncertain attributions and incomplete provenance are common in the art market, particularly with older works, and transparency is always preferable to speculation. The listing title, description, photographs and structured artwork details should all refer to the same item and should accurately represent its current condition.

Originals & Reproductions

Every listing must clearly identify whether the artwork being sold is an Original or a Reproduction. An original may include a unique painting, drawing, sculpture or illustration, as well as an artist-created print such as an etching, engraving or lithograph where the print itself forms part of the artist's original practice.

A reproduction is a later copy or printed version of an existing artwork. This may include giclée prints, archival reproductions, facsimiles and other reproduced images. Sellers must never describe a reproduction as an original artwork. Where a reproduction is based on a historic work, the artwork date and century should refer to the original composition, while the listing description should make the nature of the reproduction clear.

Attribution & Authenticity

Attribution is particularly important when selling historical artwork. Sellers should only make claims about authorship that they can reasonably support. Dark Gloomy Art uses recognised art-market terminology to help distinguish between different levels of attribution. A work described as By the Artist should only be presented that way where the seller has reasonable grounds to regard the authorship as established.

Where authorship is uncertain, terms such as Attributed to, Workshop / Studio of, Circle / Follower of, After the Artist, or Unknown / Anonymous should be used where appropriate. Supporting information such as provenance, labels, inscriptions, previous auction records, certificates or expert opinions may be included where available. Dark Gloomy Art provides the marketplace through which sellers and buyers connect; sellers remain responsible for ensuring that the information and representations made in their listings are accurate.

Condition & Photography

Condition is an important part of any artwork listing, particularly for historic and original works. Sellers should disclose significant damage, restoration, repairs, losses, staining, fading, cracking, tears, surface wear or other condition issues that a reasonable buyer would want to know about. Normal signs of age do not necessarily make an artwork unsuitable for sale, but they should be represented accurately.

Photographs should be clear, well lit and show the actual artwork being offered. Where relevant, sellers should include images of the full work, details of the surface, signature or inscriptions, the reverse, frame and any areas of damage or restoration. Images should not be edited in a way that materially changes the appearance, colour, condition or characteristics of the artwork.

Pricing Your Artwork

Sellers are responsible for setting the price of their artwork. When deciding on a price, consider factors such as the artist or maker, age, medium, dimensions, condition, provenance, rarity, previous sales and current demand for comparable works. For contemporary works, sellers may also consider their existing sales history, gallery representation and pricing across other channels.

We recommend setting a realistic and defensible price rather than relying solely on asking prices seen elsewhere. The value of artwork can vary considerably, and an attractive listing price should reflect both the qualities of the work and the wider market. Any shipping costs or other charges should also be presented clearly so that buyers understand the total cost before purchasing.

Marketplace Commission

Dark Gloomy Art charges sellers a 15% commission on completed sales made through the marketplace. The commission is deducted from the artwork's selling price as part of the marketplace transaction.

For example, if an artwork sells for £1,000, the Dark Gloomy Art seller commission would be £150, leaving £850 before any applicable payment-processing costs or other charges associated with the transaction. There is currently no additional Dark Gloomy Art marketplace commission charged to the buyer. The aim is to keep the fee structure straightforward and transparent, so sellers can understand their expected proceeds before listing an artwork.

Shipping & Packaging

Sellers are responsible for preparing sold artworks appropriately for transport and providing accurate delivery information. Packaging should take into account the size, weight, medium, frame, surface and value of the artwork. Original paintings, works on paper, framed pieces and sculptures may require different approaches to packaging.

Where appropriate, sellers should use tracked delivery and consider insurance for valuable or irreplaceable works. Higher-value or particularly fragile artworks may be better suited to specialist art couriers.

Packages should be dispatched to the address provided through the marketplace transaction. Sellers should retain relevant tracking information and proof of dispatch. For international orders, sellers should also provide accurate customs information where required. Buyers may be responsible for import duties, taxes or other charges imposed by their destination country.

After a Sale

Once an artwork has sold, sellers should prepare and dispatch the order within the timeframe stated in the listing or agreed with the buyer. The artwork should be packaged carefully and sent using the delivery method described at the time of purchase.

Clear communication is important. If there is an unexpected delay, delivery problem or other issue affecting the order, the buyer should be informed promptly. Sellers should retain proof of postage, tracking details and any other documentation relating to fulfilment until the transaction has been completed successfully.

If a buyer raises a concern regarding delivery, condition or the accuracy of the listing, sellers are expected to respond professionally and work towards an appropriate resolution in accordance with the marketplace terms and any applicable consumer rights.

Seller Standards

Dark Gloomy Art is intended to be a trusted marketplace for collectors and sellers of distinctive art. Maintaining that trust depends on sellers presenting their works accurately and dealing with buyers professionally. Listings must not contain knowingly false, misleading or exaggerated claims about authorship, provenance, age, condition or value.

Sellers should communicate respectfully, respond to reasonable questions about their artworks and provide additional information where appropriate. Transactions initiated through Dark Gloomy Art should be completed through the marketplace. Sellers should not attempt to move a marketplace transaction off-platform in order to avoid marketplace fees or protections.

We reserve the ability to review listings or seller activity where information appears inaccurate, misleading or inconsistent with marketplace standards. Our goal is straightforward: buyers should be able to understand what they are purchasing, and responsible sellers should have a professional place to present their work.

Shipping & Returns

Purchasing artwork often involves items that are unique, fragile or difficult to replace. Dark Gloomy Art therefore encourages both buyers and sellers to take particular care when arranging delivery, packaging and returns.

The information below explains the general standards expected when artwork is bought and sold through the marketplace. Individual listings may contain additional delivery or return information, and a buyer’s legal rights can vary depending on the seller, the countries involved and the circumstances of the transaction.

Shipping & Delivery

Shipping arrangements may vary according to the size, weight, value, location and nature of the artwork being purchased. Sellers are responsible for providing clear and accurate delivery information within their listings and for using a delivery method appropriate for the work being sold. Buyers should review all available shipping information before completing a purchase, including any stated delivery costs, estimated dispatch times and geographical restrictions.

Original paintings, framed works, works on paper and sculptures may require different shipping methods. Particularly large, valuable or fragile pieces may need specialist handling rather than a standard parcel service. Once an order has been placed, sellers should prepare and dispatch the artwork within the timeframe stated in the listing or otherwise agreed with the buyer.

Buyers are responsible for ensuring that the delivery address entered during checkout is complete and accurate. Where possible, someone should be available to receive valuable or fragile artwork in person. If circumstances change after an order has been placed, buyers and sellers should communicate promptly through the marketplace.

Packaging Artwork

Artwork should be packaged with care and in a way that reflects its materials, construction, condition and value. Sellers are responsible for choosing suitable packaging and taking reasonable precautions to protect the artwork throughout transit. Packaging should be strong enough to withstand normal handling during transportation and should minimise movement within the parcel.

Works on paper may require rigid protection and moisture-resistant wrapping. Framed artwork may require reinforced corners, surface protection and additional cushioning. Paintings should be protected so that packaging materials do not damage the painted surface, while sculptures and three-dimensional works may require individually fitted protection and more substantial outer packaging. Where an artwork is especially valuable, unusually fragile or difficult to replace, sellers should consider whether professional packing or a specialist art-shipping service would be more appropriate.

Any framing, glazing or other components included in the sale should also be appropriately protected. Buyers are encouraged to retain the original packaging until they have inspected the artwork and are satisfied that it has arrived safely.

Tracking & Insurance

Whenever reasonably possible, sellers should use a tracked delivery service and provide the buyer with tracking information once the artwork has been dispatched. Tracking creates a clear record of the shipment and helps both parties follow the progress of an order. For original, valuable, rare or irreplaceable artworks, sellers should also consider using a delivery service that provides appropriate insurance or compensation in the event of loss or damage.

Standard courier compensation limits may be significantly lower than the value of some artworks, and certain carriers may exclude particular categories of fine art, antiques or fragile objects from ordinary cover. Sellers should therefore check the terms of their chosen delivery provider before dispatching valuable works. Where specialist insurance or art transport is appropriate, this should be factored into the delivery arrangements and communicated clearly to the buyer. Sellers should retain proof of dispatch, tracking details and any relevant insurance documentation until the transaction has been completed successfully.

International Orders & Customs

Dark Gloomy Art may bring together buyers and sellers located in different countries. International purchases can therefore involve additional shipping requirements, customs procedures and charges. Sellers are responsible for completing any customs documentation required for international delivery accurately and honestly. This may include providing information about the contents, value and nature of the artwork.

Depending on the destination country, buyers may be required to pay customs duties, import VAT, taxes, handling fees or other charges imposed by local authorities or delivery companies. Unless expressly stated otherwise in the listing or transaction, these charges may not be included in the artwork or shipping price and may be payable separately by the buyer.

Customs procedures can also affect delivery times. Delays caused by customs authorities are outside the normal control of the marketplace and may also be outside the seller's control. Buyers considering an international purchase should familiarise themselves with any taxes, restrictions or import requirements that may apply in their country before placing an order, particularly when purchasing higher-value artworks or items containing regulated materials.

Delivery Times

Estimated delivery times should be treated as guidance unless a specific delivery date has been expressly agreed. Sellers should provide realistic dispatch estimates and should not mark an artwork as dispatched before it has actually been handed to the relevant delivery provider.

Delivery times can vary depending on the seller's location, buyer's location, courier, artwork size and whether specialist packaging or transport is required. International deliveries may take longer due to customs processing and local delivery arrangements. If a seller becomes aware of a significant delay, they should notify the buyer as soon as reasonably possible and provide updated tracking or delivery information where available.

Likewise, if tracking indicates a problem or an order has not arrived within a reasonable period after the expected delivery date, the buyer should contact the seller promptly so that the matter can be investigated. Clear communication between buyer and seller is especially important where an artwork is unique and cannot simply be replaced with another identical item.

When Your Artwork Arrives

Buyers should inspect both the parcel and artwork as soon as reasonably possible after delivery. Before opening a valuable or fragile artwork, check the exterior packaging for signs of crushing, punctures, water damage, tearing or other visible problems.

Where the parcel appears damaged, we recommend taking photographs before opening it. For particularly valuable works, buyers may also wish to photograph the unpacking process. These images can provide useful evidence if a shipping claim later becomes necessary. Carefully compare the received artwork with the listing photographs, description and stated condition.

Some historic and original works will naturally show signs of age, including craquelure, surface wear, fading, previous restoration or minor imperfections. These should be distinguished from new damage that appears to have occurred during transportation. Keep all packaging materials until you are satisfied that the artwork has arrived safely and matches the listing. If there is a significant problem, contact the seller promptly through the marketplace and provide clear photographs and details of the issue.

Damaged or Lost Orders

If an artwork arrives damaged, the buyer should contact the seller as soon as reasonably possible.

Do not immediately dispose of the packaging, as the seller or delivery company may require it when investigating a claim.

Where an insured or tracked service has been used, the seller may need to submit a claim to the courier or insurer. Buyers should cooperate with reasonable requests for photographs or information needed to support that claim.

If a shipment appears to be lost, sellers should first check the tracking information and contact the delivery provider where appropriate.

Because many original artworks are unique, replacing a lost or severely damaged work may not be possible. Depending on the circumstances, an appropriate resolution may instead involve a refund, return, insurance claim or another remedy available under the relevant transaction terms or applicable law.

Returns & Cancellations

Return and cancellation rights can vary considerably depending on the nature of the transaction. Factors that may affect a buyer's rights include whether the seller is acting as a business or private individual, where the buyer and seller are located, whether the artwork is made to order or personalised, and the consumer protection laws that apply to the transaction.

Sellers should clearly communicate any applicable return conditions within their listing or seller information and must not describe a policy in a way that removes rights that a buyer is legally entitled to exercise.

Buyers should review the listing and applicable marketplace terms before purchasing. A change-of-mind return may be treated differently from a situation where an artwork is damaged, materially misdescribed or otherwise not supplied as agreed.

Original artwork may also require particularly careful return arrangements because of its value, fragility and uniqueness. Where a buyer wishes to request a return, they should contact the seller promptly through the marketplace before sending the artwork back.

Returning an Artwork

An artwork should not normally be returned without first communicating with the seller and confirming the appropriate return arrangements.

Where a return has been agreed or is otherwise required, the buyer should package the artwork carefully and, wherever reasonably possible, use the original packaging.

The artwork should be returned in the same condition in which it was received, except where the return relates to damage or another condition issue already reported to the seller.

For valuable works, a tracked and appropriately insured return service is strongly recommended.

Your Legal Rights

Nothing in Dark Gloomy Art's marketplace guidance is intended to exclude, restrict or replace rights that buyers or sellers may have under applicable law.

Consumer rights can differ depending on the countries involved and whether the seller is acting in the course of a business or as a private individual.

For example, transactions between a consumer and a professional seller may be subject to different rules from a purchase made from a private collector.

Marketplace policies, individual seller policies and listing descriptions should therefore be read alongside any legal rights that apply to the transaction.

Sellers are expected to comply with applicable consumer protection, distance-selling, product, tax, customs and other legal requirements relevant to their activities.

Where there is uncertainty about legal rights or obligations in a particular transaction, buyers and sellers may wish to seek independent advice appropriate to their jurisdiction.
